Terms of Service

Effective 14 October 2026 · Contact: [email protected]

1. The service

Aver provides continuous validation tooling for bioinformatics pipelines: dependency fingerprinting, benchmarking against public reference materials, drift detection, run QC trending and evidence generation ("the Service"). The open-source CLI is licensed separately under Apache-2.0; these terms cover the hosted platform at app.aver.bio and its API.

2. What Aver is not

Aver produces validation evidence. It does not certify, accredit or approve anything. Determinations about the fitness of a pipeline for clinical use remain the responsibility of the laboratory and its accrediting body. Nothing in the Service constitutes regulatory, legal or medical advice, and use of the Service does not by itself satisfy any regulatory requirement.

3. No patient data — your obligation

The Service is designed never to receive patient data, and you agree not to send any. You must not upload, or configure any integration to send, patient genomes or reads, VCFs derived from clinical samples, patient identifiers, clinical sample names or clinical annotations. The Service rejects uploads whose sample names do not match a registered public reference material, but that guard does not shift the obligation: you are responsible for ensuring nothing you send contains patient data or protected health information. Aver is not a HIPAA business associate and no business associate agreement is offered, because none is needed when no PHI is processed.

4. Accounts

You are responsible for your credentials, for enabling and protecting two-factor authentication, and for the actions of the members and API keys of your organisation. Keep your roles accurate: regulated actions (promoting baselines, waiving drift, signing evidence) are restricted by role and recorded in an append-only audit log.

5. Acceptable use

No abuse: do not probe or disrupt the Service, attempt to access another organisation's data, resell the Service without agreement, or use it to build a directly competing product by systematic extraction. Read-only source integrations must remain read-only.

6. Your data and records

Your organisation's data is yours. You can export evidence packs and the audit log at any time, including after cancellation during the export window. We process personal data as described in the Privacy Policy.

7. Fees

Paid plans are billed as agreed at purchase. Fees are non-refundable except where required by law or agreed in writing. We may change pricing with notice effective at your next renewal.

8. Availability and changes

We work to keep the Service available and your evidence verifiable, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We may improve or change features; we will not materially degrade the verifiability of evidence you have already generated.

9. Liability

To the maximum extent permitted by law, Aver's total liability arising out of or related to the Service is limited to the fees you paid in the twelve months before the claim, and neither party is liable for indirect, incidental, special or consequential damages. Nothing limits liability that cannot be limited by law.

10. Termination

You may cancel at any time. We may suspend or terminate accounts that materially breach these terms, including the no-patient-data obligation, with notice where practicable. Sections 2, 3, 6, 9 and 11 survive termination.

11. General

These terms are the whole agreement for the Service unless superseded by a signed order form. If a provision is unenforceable the remainder stands. Questions and notices: [email protected].
